Welcome to AtomicHost. By accessing our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Introduction and Definitions

AtomicHost is a South African-based game server hosting provider.

  • "Service" refers to any game server, hosting, or associated technical support provided by AtomicHost.
  • "User" refers to any individual or entity that registers for an account or uses our services.

2. Account Registration

  • Age Restriction: You must be 18 years of age or older to enter into a binding contract with us. If you are under 18, you may only use our services with the supervision and consent of a parent or legal guardian who agrees to these terms on your behalf.
  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
  • Security: You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account. We strongly recommend the use of 2FA.

3. Acceptable Use Policy (AUP)

Users are strictly prohibited from using our services for:

  • Hosting or distributing illegal content, including pirated software, child exploitation material, or content infringing on intellectual property rights.
  • Engaging in activities that disrupt or harm networks, including DDoS attacks, port scanning, or the distribution of malware.
  • Cryptocurrency mining, bulk unsolicited email (spam), or any activity that excessively utilises system resources to the detriment of other customers.

Takedown Requests: We reserve the right to suspend or terminate services immediately upon receiving a valid abuse report or DMCA notice, pending an investigation. You may submit abuse reports via email.

4. Billing, Payments, and Refunds

  • Pricing: All pricing is listed in South African Rand (ZAR). We reserve the right to adjust pricing. Existing subscribers will be notified in advance of any price changes.
  • Payments: Payments are processed via third-party providers. We do not store credit card details on our servers.
  • Late Payments: Failure to make payment by the due date may result in the immediate suspension or termination of your server.
  • Prompt Service Activation: By completing your purchase, you acknowledge and agree that AtomicHost services are digital in nature and are provisioned promptly upon receipt of payment.
  • Waiver of Cooling-Off Period: In accordance with Section 44(2)(c) of the Electronic Communications and Transactions Act (ECTA), you expressly request that the provision of services commences immediately upon successful payment. By doing so, you acknowledge that you waive your right to a 7-day statutory "cooling-off" period, as the service has already begun with your consent.
  • Discretionary Partial Refunds: While the statutory cooling-off period is waived, AtomicHost may, at its sole discretion, provide a pro-rated partial refund for unused service time if a user cancels their subscription. Partial refunds are not guaranteed and are assessed on a case-by-case basis.
  • Refund Exceptions: No refunds (full or partial) will be provided if:
    • The service was terminated due to a violation of our Acceptable Use Policy (AUP).
    • The user has utilized the server resources in a manner that negatively impacted other users or system performance.
    • The request is made after the billing cycle for the service has concluded.

5. Service Availability and Support

  • Uptime: While we strive for 100% uptime, our services are provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service.
  • Support: We aim to respond to all support tickets within 1-6 hours, with a maximum target of 24 hours during high volume. Support is managed via support emails and Discord.

6. Data Retention and Backups

  • Backups: You are solely responsible for maintaining independent backups of your server data. AtomicHost is not liable for data loss.
  • Data on Termination: If an account is suspended or terminated, we reserve the right to delete server data after a period of 30 days, unless otherwise required by law.

7. Privacy and POPIA Compliance

We value your privacy and comply with the Protection of Personal Information Act (POPIA).

  • Data Collection: We collect only the information necessary to provide our services (Usernames, Email, IP addresses, Payment metadata).
  • Processing: Your data is used for service delivery and communication. It will not be sold to third parties.
  • Access: You have the right to request access to, correct, or delete your personal information by contacting our support team.

8. Limitation of Liability

To the maximum extent permitted by South African law, AtomicHost shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of data or business interruption) arising from the use or inability to use our services. Our total liability is limited to the fees paid by the user for the specific service in the 3 months preceding the claim.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be settled through mediation or within the jurisdiction of the South African courts.
